PHH Mortgage Must Face Inspection Cost Markup Suit

Law360 (Jun 29, 2021, 10:56 p.m. EDT) – A federal judge in Florida ruled Monday that PHH Mortgage Corp had defaulted loans curtailing one constructive fraud claim but advancing all other claims.

US District Judge Paul G. Byron allowed plaintiff Kirk Culver’s violations of contract and violations of the Fair Debt Collection Practices Act as well as allegations of violations of the Florida Consumer Collection Practices Act regarding the mortgage lender’s termination requirement to stand.
